Federal Judge Orders Release of Kilmar Abrego Garcia from Immigration Detention
A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without lawful basis.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.
The case originates in a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to answer human smuggling charges, he was detained in immigration detention.
In her decision, the court noted that the government lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
